I. DEFINITIONS

Terms used in these Regulations:

1. User - an adult natural person with legal capacity, as well as a legal person or an organizational unit that is not a legal person with legal capacity, which uses the Website.

2. Privacy Policy - a document containing information and rules regarding the processing of Customer's personal data, available at the Internet address www.gomabox.com.pl/polityka-prywatnosci

3. Website Regulations - Regulations of the Website www.gomabox.com.pl

4. Website - functionalities related to services provided electronically, made available by GoMa at the internet address www.gomabox.com.pl

5. GoMa- GoMa Mariusz Markut based in Stalowa Wola, ul. Kazimierza Mireckiego 13, 37-450 Stalowa Wola, entered into the Central Register of Business Register and Information No. 601/1999, REGON number: 690573141, NIP number: 865 001 04 15, being the entity administering and running the Website.

II. GENERAL PROVISIONS

1. The Website Regulations define the rules of using the Website, run and administered by GoMa, and the services offered on the Website.

2. The use of the Website is based on the Regulations. Before using the Website, the User is obliged to read the content of the Website Regulations.

3. The Website, including the services offered within the Website, are dedicated to adults. Acceptance of the Website Regulations by the User is tantamount to confirmation of his / her adulthood.

4. The Regulations of the Website are made available on the Website in a form that enables the acquisition, playback and recording of its content using the ICT system used by the User.

III. RULES OF PROVIDING SERVICES ON THE WEBSITE

1. The provision of services to the User on the Website is free of charge. The contract for the provision of these services is concluded for an indefinite period.

2. As part of the Website, GoMa enables:

a / viewing, playback and reading by Users of information and materials (including photos, texts, graphics, etc.) made available on the Website, in particular information and materials about goods and other services offered through the Website by GoMa.

b / establishing a contact by the User with a GoMa employee (customer caretaker) by means of the inquiry form available on the Website.

3. Agreement for the provision of electronic services:

a / in the case of the services referred to in point 3.2.a - shall be concluded upon the acceptance of the Website Regulations and shall be terminated upon the User's leaving all pages of the Website.

b / in the case of the services referred to in point 3.2.b - is concluded when the User contacts a GoMa employee as part of the forms available on the Website and is terminated when the User ends their use of the service.

IV. USING THE SERVICE

1. The User is obliged to use the Website and the services offered in a manner consistent with the law, the Website Regulations, decency, and in accordance with the principles of social coexistence.

2. The User is obliged to refrain from any actions violating the law, good manners, property or personal rights of third parties, and in particular using the data of other people as their own.

3. It is forbidden for the User to provide illegal, offensive, misleading information, and content that may cause disruptions to IT systems via the Website.

4. GoMa is not responsible for the content and security of websites belonging to other entities, to which links are posted on the Website, or to which you have been automatically redirected, eg a link to Facebook.

5. GoMa, within the limits permitted by law, is also not responsible for:

a / any damage caused to third parties resulting from the User's use of the Website in a manner inconsistent with the Website Regulations or applicable law.

b / any damage caused to third parties as a result of providing false, incomplete or misleading data by the User.

c / any damage resulting from the User's use of data and information from the Website for economic and business purposes, etc.

V. TECHNICAL REQUIREMENTS

1. Using the Website requires meeting the following technical requirements:

a / access to the current version of the web browser: Mozilla Firefox, Internet Explorer, Opera or Google Chrome.

b / operating system: Windows, Mac OS, Linux, Android, iOS.

c / JavaScript support enabled.

d / access to the Internet.

e / e-mail - if the User expresses the will to receive information or reply via e-mail, or to receive marketing and commercial information from GoMa, as well as if the User wishes to contact a GoMa employee as part of the form.

f / minimum recommended screen resolution: 1024x768.

g / enabled cookies.

2. If the User uses hardware and software that do not meet the technical requirements specified in point 5.1, GoMa does not guarantee the proper functioning of the Website.

3. GoMa is not responsible for interruptions in the provision of services resulting from failures or malfunctions of ICT systems beyond the control of GoMa.

VI. CUSTOMER'S PERSONAL DATA

1. The rules for the processing and protection of personal data of Website Users, including the rules for the use of cookies, are set out in the Privacy Policy available at www.gomabox.com.pl/polityka-prywatnosci.

VII. COPYRIGHT

1. The User may not infringe the copyright and other intellectual property rights to the content posted on the Website by GoMa or other entities.

2. Any content posted by the User on the Website may not infringe copyright, trademark rights or other rights of other entities.

3.The User, in the event of any claims by third parties to GoMa regarding the violation of any rights to the content posted by the User, will take all necessary steps to release GoMa from liability in the said scope, including, if necessary, joining the case in place of GoMa or will join the case on the GoMa side. In addition, the User will repair GoMa any damages incurred on the part of GoMa in connection with claims of third parties regarding the content posted by the User, including court costs and legal representation, legal advice and awarded damages and redress.

4. The User is entitled to use the content posted by GoMa on the Website only for their own use. In particular, without the authorization granted by GoMa in writing, it is not allowed to distribute, transmit, modify, post on other websites, link or use the entire Website or any part of it for commercial or public purposes. It is also forbidden to remove information on copyright and other intangible property rights, such as trademark rights.

IX. FINAL PROVISIONS

1. GoMa has the right to make changes to the Regulations to the extent permitted by applicable law, including, if necessary, technical and functional changes to the Website or changes to the law. The use of the Website by the User after the changes to the Regulations of the Website or other terms of service provision are amended, constitutes their acceptance.

2. Amendments to the Website Regulations will be published in the form of a unified text of the Website Regulations. In the event of non-acceptance of the changes to the Website Regulations, the User may resign from the services provided on the Website.

3. The law applicable to all legal relations arising from the Regulations of the Website is Polish law. All disputes are settled by Polish common courts, subject to the provisions of point 8.5 of the Regulations of the Website.

4. Any disputes with GoMa arising out of or related to its functioning will be settled by the court having jurisdiction over the seat of GoMa.

5. Doubts regarding the content of the Website Regulations should be resolved in a way that ensures compliance of the Website Regulations with the mandatory provisions of law.

6. The Regulations of the Website shall enter into force on February 20, 2021.
